Appeals to IRB
IRB is an administrative tribunal. It reports to Parliament via the Minister of
CIC, but works in dependent of CIC & CBSA.
IRB has 3 divisions:
- Refugee protection Division (RPD)
- Immigration Division (ID)
- Immigration Appeal Division (IAD)
Division Responsibility
RPD Decides claims for refugee protection made by people already in Canada
ID 1. Admissibility hearings for foreign nationals or PR who have contravened the IRPA
2. Hearings of foreign nationals or PR held in detention for immigration reasons
IAD 1. Appeals by sponsors whose applications to bring family members to Canada have been refused by CIC
2. Appeals of removal orders made against PR, refugees, protected persons
3. Appeals by PR not met their residency obligation
4. Appeals by CBSA on decisions on admissibility made by ID
